Acknowledgment and Assumption of Risk

By accessing and using the directory of captains, charters, and boat owners (“Service Providers”) listed on the BlvckScene website provided by BS Group LLC (“Company”), you, the user, acknowledge and agree to the terms outlined in this Waiver of Liability. The purpose of this directory is solely to facilitate connections between patrons attending the BlvckScene festival and independent Service Providers for the chartering of boats and hiring of captains. It is understood that the Company is not a party to any agreements entered into between patrons and Service Providers, nor does the Company vet, endorse, or directly provide the services listed.

Waiver and Release of Liability

You hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, “Releasees”), on account of injury, death, or property damage arising out of or attributable to your use of the Service Providers listed in the directory, whether arising out of the negligence of the Company or any Releasees or otherwise. You covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims.

Indemnification

You shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, arising from or relating to your use of the Service Providers listed in the directory or your breach of this agreement.

Assumption of Risk

You understand and acknowledge that the activities associated with boating and charter services carry inherent risks, including but not limited to the risk of bodily injury, death, or property damage. You voluntarily assume all risks related to such activities and agree that the Company and all other Releasees shall not be liable for any acts, omissions, loss, injury, or damage of any kind incurred as a result of your use of the Service Providers listed in the directory.

Choice of Law

This Waiver of Liability shall be governed by and construed in accordance with the laws of the state/jurisdiction in which the Company is registered, excluding its conflict of law rules.

Acknowledgment

By using the directory of Service Providers on the BlvckScene website, you acknowledge that you have read and understood this Waiver of Liability and agree to be bound by its terms. You also represent that you are of
